What kind of ethical difficulties does the ABA code of ethics create for the conscientious lawyer? One of the ethical difficulties that the ABA code creates for the conscientious lawyer occurs when the lawyer gets a guilty client off on a crime that they know they committed. Another ethical difficulty occurs because the code states that they must defend their client even If they know they are guilty, they must do everything they can to win an acquittal but they also have an ethical obligation to prevent another crime from happening.The dilemma occurs when they know their client will commit the same crime again. The conscientious lawyer is also instructed by Canon 7 not to make his own decision about what is just. He cannot take on the role of Judge or Jury. He must leave it in the hands of the Judge or Jury to decide his client's guilt or innocents. If a lawyer finds it difficult to handle such a situation they can take solace in the belief of Samuel Johnson whose belief it was that the truth is decided by the court's verdict not the conscious of the lawyer. Dry.Johnson states that even if you, the lawyer on a case feels that his/her arguments are weak they don't know If they might convince the Judge anyway and If It does then the lawyer was wrong and the Judge was right. They treat others justly when distributing goods or services. They do so in a manner that shows no partiality to one particular group over another unless their need is rater.The morally good person is truthful. They demand some measure of moral courage. They tend to do what they deem as morally right even if that means suffering hardships for their stand. They have respectable monetary habits. A morally good person is disposed to good for others. They do it not for themselves but just because It is the right thing to do. A morally good person is trustworthy. Lastly Cohen says that a morally good person has their own moral compass and that they will follow their own moral principles.

I Knew This Was My Moment

I could remember when I was young, one day, my mother suddenly dragged me out to a concert that I wasn’t all that enthusiastic about. I was planning on persuading my mother otherwise, but the moment I stepped in and the concert started, I immediately fell in love. I was enchanted by the stage effects, the dancers, and the pure vocal talent of the artist. It was then that everything had started, and my world had changed. At that moment, I knew what I wanted in life.Immediately after the concert, I told my mother that I wanted to sign up for vocal and dancing lessons. Needless to say, she was astonished at my sudden change of attitude, but she seemed to understand. Over the years, I trained, and over the years, my passion grew. My life revolved around the dance and vocal lessons I took. But of course, my studies weren’t neglected; I needed a back-up plan if my plans to become a star fell through, though I would definitely prefer if it didn’t.Many people said that a spiring to become a singer was not realistic, that it was just that, a dream. But I never wavered, I never felt discouraged, and most importantly, I never lost hope. When I was sixteen, I took part in a local singing competition, and was unexpectedly scouted by a representative of a small talent agency. He gave me his name card, introduced himself, and told me to call if I was interested. That day, I ran all the way home, and told my parents.Although they didn’t seem to agree with me, being only sixteen and all, they eventually caved in with my constant begging. With their consent, I immediately dialed the number on the card, I wasn’t about this chance pass me by. After that phone call, my life took another turn. I was thrown into a busy life with almost no free time for myself. I’d spend the whole morning in school, and then my afternoons, and sometimes evenings, as a trainee at the agency. Although every day was tiring, I enjoyed those days.That life lasted fo r about four months. After four months as a trainee, they decided that I had enough training, that I was good enough and could finally have my debut, with all the lessons I had before entering the agency. The moment I received the news, I was ecstatic for days, almost nothing could bring me down. The two months after that were spent writing and composing songs. It was decided that they would strip away all other stage effects and focus on my voice, which was my forte.And now, sitting in the preparation room while make-up artists do their final touch up on my face, I recall the past and how my dream had started. Instead of letting my dream remain a dream, I was about to make it come true. More than nervous, I feel excited. Instead of standing below the stage, watching performers enchant the audience, it was finally my turn to stand upon that ground and demand the attention of the whole stadium. Standing backstage and watching the audience of hundreds, maybe a thousand, I could feel t he nerves getting to me, and then the excitement overriding the nerves.The curtains closed upon the end of the previous act, a signal for me to go on stage. This was it, I thought, as the MC introduced me, the curtains opened, and the lights blinded me. Blinking a few times as my eyes adapted to the light, I could see clearly right in front of me, the thousands of people in the audience. At that moment, I knew. I knew that this was my moment, and it was going to be all or nothing. This was the moment I have been waiting for all my life, the moment I have gone through all the blood, sweat and tears for.This was the moment that would change my life, for good; the moment that would decide if my career as a celebrity would turn for the better or for the worse. After all, in the entertainment industry, it’s the first impression that counts. Standing on the extravagant stage, half blinded by the lights, in awe of the number of people in the audience, and excitement rushing through every pore of my being, I sung my heart out, expressing my ineffable feelings for it, for music. Giving it my all, all I could do now was hope that my all was enough.

It is just filled with 5 poetic lines which we had to either do a free verse poem, poems without rhyming or patterns and that don‘t follow any rules, or a blank verse which is a poem that uses no rhyming but has iambic pentameters (patterns). Or you can do a rhyme verse which is a poem that uses rhyming. My poem is blank verse because even though I have no rhyming I have a pattern. You see I repeat the word â€Å"reason† a few times and it follow a pattern. Read ona The Room No matter how many times I tell him, He never cleans his room! On how dirty it is! At last I punished him with a ban on T. V. That’s when the stink went away. Description This poem is a poem with a speaker. A speaker poem is a person that is talking in the poem. Sometimes the speaker can be the author itself talking in the poem. Other times it is a made up character. In this case, you can figure out that the speaker is the kids mother because she â€Å"banned him with no T. V. † until his room is cleaned up. Figurative language is a term in poetry when you compare two unlike things to make something clear. For example if I say the soap bubbles in the bath tub are like clouds in the sky, I am comparing the soap bubbles to the clouds, but the soap bubbles aren’t really clouds, right? Assonance is when you use repetition of the sound of a vowel. I don’t think I have tat but I do have alliteration. Alliteration is the repetition of 2 or more words that end with the same sound or start with the same letter. For example in the poem I said â€Å"winter wind† both words have a â€Å"w† in the beginning. I also used â€Å"sunshine smile† which has a â€Å"s† in the beginning of each word. This is how my poem uses assonance/alliteration. Read ona The Monster Mama always said she loved me. But then why do I cry every time she came home? Why do I hide under the bed, Praying she didn’t come looking for me? Before daddy left, She told me I was her sweet little angel. So why does she tell me that she hates me? Why is it the she says I’m a nuisance? What did I do, To get black and blue, Bruises all over my body. Mama always told me, That the monster always haunts kids, Who lie and cheat and hit people. Then why did she lie to me when she told me, That daddy ran away, When she kicked him out of the house? And why did she cheat on daddy before he Went to another place? And why does she hit me with her whiskey bottle? Why does she love to see me cry When the glass cuts my skin? Mama knew what she did to me, But what she didn’t know was that the monster was, The only one that said it loved me. Description This poem is a poem on symbolism. Symbolism is the idea or topic of the poem. For example, the night is a symbol of death. Or in the poem I made the monster symbolizes the thoughts one would have after abuse. Read ona The End My past is finished, It’s all filled with pain. My past is killing me, ‘Cause I’m trapped in this lane. My mind is at war with me, I can’t control the thoughts deep inside me. The genetic susceptibility to type 1 hypersensitivity, chronic inflammation and bronchial hypersensitivity are the major factors that cause asthma. Our immune system contains Type 2 helper T cells (Th2) which is type of CD4+ helper T cell secretes interleukins. The interleukins then promote allergic inflammations and stimulate B cells to produce IgE and different antibodies. Type 1 helper T cells (Th1) are also a type of CD4+ helper T cell which secretes interferon-ÃŽ ³ (gamma) and intereukin-2. The interferon-ÃŽ ³ (gamma) and interleukin-2 activates the macrophages and cytotoxic T cells which kills the viruses and other invading organisms. These two types of helper T cells form an immunoregulatory loop that is the cytokines from type 1 helper T cells inhibit type 2 helper T cells and cytokines from type 2 helper T cells inhibit type 1 helper T cells. These two types of helper T cells respond to different immunogenic stimuli and try to destroy them. Any imbalance in the regulatory loop of these two types of helper T cells makes it easier for the viruses and agents to attack the bronchopulmonary tree and cause inflammation which leads to asthma. In patient suffering from hypersensitivity as occur in asthma, when an antigen is presented to the skin, a wheal and flare reaction occurs. This wheal and flare reaction is clear example of hypersensitivity type 1. In air passages when the allergen reaches the epithelial lining it stimulates the induction of type 2 helper T cells (Th2). The type 2 helper T cells secrete various cytokines such as interleukin 4 (IL-4) and interleukin 5 (IL-5). The interleukin 4 (IL-4) then triggers the production of immunoglobulin IgE by the B cells and promotes the growth of mast cells. The interleukin 5 promotes the growth and activation of eosinophills. The reaction mediated by IgE to the allergens elicit an acute response and late phase reaction. The acute response to the allergens consist of bronchoconstriction, edema, mucous secret ion and in rare cases the decrease of blood pressure. The acute response occurs by this mechanism; the contact of antigens to the mast cells stimulates the secretion of mediators which mediate the reaction. In the case of air passage diseases when the allergens reach the mucosal surface, the reaction of allergens first occurs with the mucosal mast cells. In this reaction mediators are secreted which opens the tight junction in between the mucosal cells and improve the entrance of the antigens to the submucosal mast cells. Close Reading Essay The answers to these questions emerge more from the doing than the talking. Briefly, close reading is a basic tool for understanding, taking pleasure in, and communicating one’s interpretation of a literary work. The skills employed in close reading lend themselves to all kinds of cultural interpretation and investigation. Close reading takes language as its subject because language can operate in different ways to convey meaning. Reading sensitively allows one to remain open to the many ways language works on the mind and heart. When an assignment calls for close reading, it’s best to start by choosing a brief but promising passage and checking your assumptions about its content at the door. Close reading often reveals the fissures between what the speaker or narrator says and how she or he says it. You know from your own experience that life involves constant, often unconscious sifting of these nuances. Here are some useful steps. 1. Choose a short passage that allows you to investigate the details closely. Here, for example, is the first paragraph of Jane Austen’s Northanger Abbey, Chapter 2. In addition to what has already been said of Catherine Morland’s personal and mental endowments, when about to be launched into all the difficulties and dangers of a six weeks’ residence in Bath, it may be stated, for the reader’s more certain information, lest the following pages should otherwise fail of giving any idea of what her character is meant to be; that her heart was affectionate, her disposition cheerful and open, without conceit or affectation of any kind—her manners just removed from the awkwardness and shyness of a girl; her person pleasing, and when in good looks, pretty—and her mind about as ignorant and uninformed as the female mind at seventeen usually is. This single sentence will give us plenty to work with. 2. Look at diction. What kinds of words does Austen use? Does she aim for lofty diction (used for special occasions) or common diction? Are the words long or short, Latinate or Anglo-Saxon, specialized (i.e. legalistic, medical, jargon, elite) or ordinary? Remember that the rules for diction are different at different times in history. 3. Next, look at sentence structure. Can you map the sentence (find the subject and verb, locate phrases and clauses)? Is it a simple, compound, or complex sentence? How does the structure of the sentence relate to its content? Does the author use active or passive verbs? What rhythms does the sentence structure create—long flowing ones, short choppy ones—and how do these relate to the meaning? 4. After you have looked at language (and there are other technical issues one might pay attention to), you can begin to analyze tone. Is the narrator being straightforward, factual, open? Or is she taking a less direct route toward her meaning? Does the voice carry any emotion? Or is it detached from its subject? Do you hear irony? Where? If so, what complications does the irony produce? 5. At this point, you may discover some difference between what the author appears to be doing (giving you a complete, unbiased picture of her character) and what she also accomplishes (raising doubts about whether these qualities are worth having, whether her character is a heroine after all, whether women have minds at all, therefore whether this narrator can be trusted at all, etc.). You can now begin to talk about the ways Austen’s language, which seems to invite our confidence, is also complicating its message by raising these doubts. 6. At this point, you can propose a generic hypothesis, something like, â€Å"In this passage, Austen raises doubts about Catherine Morland’s character through her use of deliberately banal diction, her strained sentence structure, and her ironic use of the terms of character description for heroines.† 7. You can proceed to fill in the outlines of this point by explaining what you mean, using details and quotations from the passage to support your point. 8. You still, however, need an argument and will need to go back to your opening to sharpen the thesis. The question is Why? Or to what effect? Your thesis might build on what you’ve already written by suggesting: Austen creates this irony early in the novel to alert the reader to the ways she’s subverting narrative conventions. Or: The effect of this description of Catherine is to undermine any notion of her powers as a heroine and to introduce Austen’s theme that true character emerges from weakness rather than strength. Or: Austen’s cavalier treatment of her heroine suggests that she has little respect for the typical education of young women. 9. Even with these more developed statements, you will need to explain and support your point further. But you will have achieved some very important things, namely: 1) you have chosen a specific piece of the text to work with, hence avoiding huge generalizations and abstractions that tend to turn a reader off; 2) you have moved from exposition (explaining what’s there—and really, shouldn’t a reader be able to figure these things out for him or herself?) to arguing a point, which will involve your reader in a more interactive and risky encounter; 3) you have carved out your own reading of the text rather than taking the more well-worn path; 4) you have identified something about Austen’s method that may well open up other areas of the text for study and debate. Bravo! 10. With your more refined thesis in place, you can go back and make sure your supporting argument explains the questions you’ve raised, follows through on your argument, and comes to a provocative conclusion. By the end, you may be able to expand from your initial passage to a larger point, but use your organization to keep the reader focused all the way. The most exciting thing for a reader, and the most useful for an essayist, is that close reading generally offers surprises. Your project is not so much about telling readers what they probably can see for themselves but what they might have missed that could delight them. It’s helpful, then, to go into the paper with an open mind and be ready to adjust your thesis to the evidence you find in the text. Have a blast!

Through negotiation conflict between travel agency and customer can be reduced. Negotiating through areas of conflict can often lead to win-win situations agreeable to parties, reducing ill felling and conflict (Queensland Government, 2011). This means they have variety of choices that they can get from their travel suppliers and they can give us the best deal with best value of possible. Online booking lack of first hand knowledge and rarely gives customer opportunity to speak with someone knowledgeable about service that they are booking (Morelock, 2012). Online booking allow customer to make all travel plans on the internet means they can do it any time of the day or night at home or while theyre on their lunch break at the office (Oakley, 2012). It is true when we are doing booking online we can make a booking everywhere and anytime but we cannot negotiate the price of the tourism product that we wish to book. If we are negotiating with travel agents, we have the chance to get lower prices as possible. Price negotiation usually occurs during purchasing of materials or supplies (Francois, 2012). For example, if a travel package to Cameron Highlands costs about RM300 for two nights, the clients can negotiate the price lower and can get around RM250. With negotiations, both parties will receive their own benefits and it is a win-win situation (Rusk, 2006). When customer asks an agent to negotiate, means customer are essentially asking the agent to subsidize their vacation (Brock, 2009) but through online system, customer had no change to negotiate with an agent because the price is fixed. The Marriott International, Hilton Hotels, Sheraton Hotels Resorts and others was charged in San Francisco Federal Court on charges conspired to use their market dominance to fix the hotel prices with travel websites like Travelocity, Booking.com and Expedia, a subsidiary of Priceline.com From this case we can see that customer cannot negotiate the price because the price is fixed. The aim of the negotiations is to decide the price that is acceptable for both parties (Francois, 2012) From price negotiation process it becomes bargaining process. Negotiations commonly follow a process of positional bargaining (Cutts, 2012). Oxford Online Dictionary give two interpretation of bargaining, the first is an agreement between two or more people or groups as to what each will do for the other. The second is a thing bought or offered for sale much more cheaply than usual or expected. There are two types of negotiation which are distributive bargaining and integrative bargaining (Robbins Judge, 2003). Distributive bargaining also called claiming value, zero-sum or win-lose bargaining is a competitive strategy that is used to decide how to distribute a fixed resource such as money (Spangler, 2003). Honeyman (2012), interpret intergrative bargaining as one of platform which party try to understand interests of another party, on the expectation that it will helping the opponent to create solution as responsive its own concerns. According to Tewart (2012), many times people sa y they dont like to negotiate (bargaining) yet, they still shop around and never pay full price. The word bargaining here does not only mean price negotiation, it is a much differentiated and broader term (Management Study Guide, 2012). Customer also can bargain to build his or her own trip with or without help from a customer care executive (Agarwal, 2012), asking whether travel agency offer travel insurance (trip Travel Responsibility Informed Protected, 2012) and a customer can seek redress under certain circumstances commonly referred as the right to repair, replacement or refund (Government of South Australia, 2011). These are things that customer can bargain with travel agencies. The freedom of customer is restricted when they make booking through online. Customer cannot confirm their specific requirement when make the online booking through the hotel reservation system (Vyas, 2010). For example, when they make booking through hotel reservation system, if they have something that they dont understand, no place for them to raise the questions. One of the advantages of booking direct with the hotel, by phone or email, is that customer can request a specific room of the hotel and they cannot normally do that online or with an agent (Trend, 2010) According to Tewart (2012), most people act in their best interest and most people who say they dont like negotiating, actually still want to. This statement show that customers still love to negotiate and online booking system prevent them from doing it. Negotiation is needed in order to secure the resources required for successful project completion (Evans Lindsay, 2008). Through negotiating win-win solutions with customers it will not only give your company the best chance to succeed but will also create relation between customer and your company for future sales opportunities (Douglas, 2003). The storm does not endanger their lives but they find themselves trapped in the middle of the lake, fighting against the wind after rowing in a constant strain. One must assume Jesus supernaturally sees the struggle in the darkness and comes to rejoin them *walking on the sea. The word teaches that the God we serve specializes in being a divine deliverer for His people as in the mythos of Israel and his disciples. The Perspective of a Child in William Faulkner’s The Unvanquished In the novel The Unvanquished, by William Faulkner, the story of a child’s journey from boyhood to manhood is told through the perspective of an adult reflecting upon the past. Faulkner uses the narrator of the novel, Bayard Sartoris, to recall numerous experiences and portray intricate details that involve time, place, and setting through several techniques of writing. Language, empirical knowledge, and tone play a major role in the readers understanding of the perspective of which the story is told. Faulkner is a master of using language as a means of giving the reader clues to what is going on in the story: subliminally and in the perspective of a child. Many times throughout the novel, he uses a tone of voice in which the reader understands that the narrator is a naive boy who is oblivious to his surroundings and what is going on in â€Å"reality.† At an early age Bayard and his playmate, a black lad named Ringo, see the world as an adventure and often bring these characteristics of imagination into real life situations. For example, the boys shoot a â€Å"Yank† (literally) in an almost playful way, which is quite similar to the way in which they play in their living quarters daily. The way in which Faulkner describes these events through the narrator tells the reader that Bayard is unaware of the consequences of his action and that he is being compelled to do things such as shooting a â€Å"Yank† based on the influence of his Father and Grandmother rather than on his own accord. The manner in which Bayard goes about his actions is very childlike and Faulkner uses naivety and the ability for the child not to think for himself to portray age. On the other hand, the reader is also aware that someone with a great deal of empirical knowledge narrates the story. Many times Faulkner uses subtle asides that give the reader more clues of the narrator’s demeanor and understanding of his surroundings. Faulkner uses phrases like, â€Å"to a twelve years old,† that tell the reader that someone with understanding and experience is speaking to directly to the reader. Within the same breath the reader is reminded that a child is actually telling the story. Faulkner chooses to make these two voices coalesce in a way to show more than one perspective and not be limited in the mind of a child.
